Police Plaintiff: Pursuits

     306:89 No liability on the part of the city for injuries to officer who was passenger in police vehicle pursuing suspect; officer driving vehicle did not act in "reckless disregard" of safety of others since he had lights and sirens operating when his car was struck by a van. Mulligan v. City of New York, 664 N.Y.S.2d 484 (A.D. 1997).
     293:75 Alleged violation of internal police department memo requiring termination of high speed pursuit when risk of pursuit outweighs risk from not apprehending suspect could not serve as basis for liability for officer's injuries in pursuit, New York high court rules; memo did not establish "clear duties," but left decision to continue pursuit to officer's discretion Desmond v. City of New York, 88 NY2d 455, 669 N.E.2d 472 (1996).
