Defenses: Improper Defendant

Lawsuit by motorist injured in car accident involving sheriff's deputy was properly dismissed when the plaintiff failed to name the county as a defendant. The sheriff's department was not, under Mississippi state law, a "political subdivision" that could be named as a defendant in the lawsuit. Brown v. Thompson, No. 2004-CA-01703, 927 So. 2d 733 (Miss. 2006). [N/R]
City police department was not a "person" subject to liability under federal civil rights statute Post v. City of Fort Lauderdale, 750 F.Supp. 1131 (S.D.Fla 1990).
